to their DA and the L&E Court agreed to hear their case. The last days of the Hearing were Oct 12-13. The Commissioner has now withdrawn to consider her decision, Yes, no, or yes with conditions. It is unlikely we will hear anything before year's end.

The developers of 303 Blackhead Rd Hallidays Point went back to the Land & Environment Court in July seeking leave to lodge amended plans for the September hearing. The Court has granted leave to do so. Accordingly, the Court decision will relate to the "new plans". "New" because there is no essential difference in the plans, save for a few less units, some street re-alignments, and a whole bunch of new consultants reports with lots more words, graphics and pictures. We need to review these plans to ensure that the position that the Community has presented to the Council and more recently the Land & Environment Court is still current. If you have any ideas to emphasise in our objection once you have had a chance to look through the new plans, either contact us per this site or if you are so moved, make a submission to Council.

Our community has expressed concerns about the 303 Blackhead Road development since it first came in front of Council in September 2017. The developers have never even bothered to consult with the Community.

After multiple public meetings, representations at Council Meetings, lobbying of Councillors, and many community member submissions to the MCC, this community's voice has been heard by the Council Management.

 

MCC has released details of its plans to "harmonise" the planning tools relating to Development Applications across the 3 former local government areas. In particular, these plans address the many anomalies that we have raised concerns about in relation to Manufactured Homes. Council has released their interim plans for Manufactured Homes, and in doing so revealed their long-term plans for only allowing MHEs to be located on land zoned for caravan parks.

 

These releases need to be read in the context of the recent proposed changes to Land Zoning across the MCC LGA.

303 Blackhead Rd is now land zoned for "low density residential" developments.

 

The "innominate" clause that was exploited by the developers of 303 Blackhead Rd is to be removed from

the planning tools across the MCC LGA.

The developers decided to take their DA to the Land & Environment Court, but then decided before doing so that they would make amendments to their plans before the hearing date. The resubmitted plans have been recognised by the Land & Environment Court. Mid Coast Council has notified the public of the new DA. We now have an opportunity to show the L&E Court how inappropriate this development is for this area. To do that we have to start again and lodge objections to the proposed development. We have come this far, so why not finish it?

Date with the Land & Environment Court Announced

 

The developers of #303 Blackhead Road have decided to refer their Development Application to the Land & Environment Court. Originally the Court provided a date in March 2020 to hear the case. However the developers decided to lodge an amended set of plans which has been accepted by the Court. These plans purport to successfully address the issues raised when the concept has previously been considered by the Mid Coast Council.

The developers have been granted a hearing date of September 2-7, 2002. A site review will be conducted on September 2, followed by the formal hearings in Sydney on 3, 4 and the 7th of September.

February 10, 2020

MidCoast Council directed to Notify Amended Plans for the DA to Construct 198 Manufactured Homes on #303 Blackhead Rd

The Land & Environment Court has agreed to "rely" on amended plans for the DA on #303 Blackhead Rd. Accordingly the MCC has put the process of notifying the public about the new DA. Chief Judge of the L&E Court Appoints New Commissioner to Hear the #303 Blackhead Rd Case 

 

A new Commissioner has been appointed to rule on the amended DA for #303 Blackhead Rd. This means that any evidence presented previously becomes a matter of history, and new submissions will be welcomed by the Community. MCC staff will be engaged in checking to see whether the amendments satisfy the Statement of Facts and Objections from the DA that was assessed by the MCC in June of 2019.

The Countdown Begins to the Final Lodgement of Objections

 

Even though the hearing date for the 303 Blackhead Rd development is not until September, MCC has set a closing date of April 10 for submissions from the public. Why so early? It takes time to analyse and decide whether each submission adds to the Council's defence. Council's legal team is working hard at ensuring the MCC submission has the necessary content to make their position very strong. Every submission made becomes evidence in front of the Court, but the MCC legal team is looking for angles and nuances that can really add to the case against building 198 manufactured homes on that block of land.

Tallwoods 303 Action says - There's Not Been Any Infrastructure Changes

When the developer tried to put 202 MHEs on the 303 Blackhead Rd site in 2018/19, Mid Coast Council said the infrastructure wasn't adequate. Nothing has changed, so why should this amended DA succeed?
